The federal appeals court has upheld a prohibition on sending national guard in the Oregon city, after a latest court ruling.

Judicial Panel Concurs to Reconsider Case

The federal appeals court decided on this week that it would rehear the legal dispute concerning the president’s authority with an larger group of eleven justices. The judicial body also overturned a earlier ruling from a three-judge panel that had sided with the federal government.

Legal Saga Over Troop Deployment

This order represents the most recent development in a long-running legal battle over whether the former president has the legal right and justification to deploy state military units in Portland. Approximately two hundred troops have been in uncertainty since late September when the deployment effort was started in response to months of protests.

Differing Viewpoints

The federal government has claimed that federal officials at the ICE facility in south Portland were facing threats, while local authorities assert that municipal police have command of the situation.

In defiance of characterizations of Portland as a conflict zone, residents have been sharing footage of lush hiking trails and a vibrant culinary culture, and organizing events such as an protest bicycle event against the “militarization of our city”.

Recent Legal Actions

The Tuesday ruling came after a US district judge in the city issued two legal injunctions this month – one preventing the federal control of the Oregon national guard, and another prohibiting the use of any national guard troops in Oregon, after efforts to circumvent the initial injunction by mobilizing out-of-state forces.

On Monday, the ninth circuit panel had put the first ruling on hold – allowing command of state troops – but the subsequent injunction remained in place, blocking the actual deployment of the troops.

En Banc Review

The latest ruling means the issue will be heard “en banc” – with all decisions under consideration together – by a panel of eleven justices.

“This decision demonstrates that the truth matters and that the courts are working to hold this administration accountable. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” said the legal representative in a statement.

“The court is sending a definite signal: the executive leader cannot dispatch the armed forces into US cities without cause. We will continue protecting state legislation, values, and autonomy as this legal proceeding moves forward and our legal battle continues in the courts.”
